Course Schedule

The Law School of the Heinrich-Heine-University Düsseldorf organises a course on European Patent Litigation composed of eight modules of two days each month, including a module with final seminar of three days. The content of the course covers the curriculum of Rule 3 of the Draft EPLC Rules.

The lectures are mainly held in English and will be given by experts from academia as well as from judiciary and by lawyers from different Member States. A University Certificate of the Heinrich Heine University Düsseldorf is awarded to successful participants after providing a sufficient Exam Paper and passing an oral examination relating to the content of the course.

The course will be held at the Heinrich Heine University Düsseldorf at their city premises, the so called “Haus der Universität” (University House), located at Schadowplatz 14, D-40212 Düsseldorf, and at the campus of the University, Universitätsstraße 1, D-40225 Düsseldorf, at the following dates:

  • Mock Trial Group Partitioning
  • Introduction into International Civil Procedure Law

2nd Module

  • Decisions of the European Court of Justice in Patent Matters

  • Conflict of Laws: International Law in Patents

3rd Module

  • Basic knowledge of Private Law (incl. Contract, Company, Tort Law in Common and Continental Law)
  • Mock Trial (2nd conference)

4th Module

  • The Roots of Civil Procedure Law in Europe
  • Patent Litigation in Germany
  • Patent Litigation in France
  • Mock Trial (3rd conference)
  • Patent Litigation in England

5th Module

  • Enhanced Cooperation
  • Interpretation of European Patents
  • Brexit und UPC
  • Mock Trial
  • Unitary Patent Protection and Unified Patent Court

6th Module

  • Rules of Procedure of the Unified Patent Court
  • Customs Enforcement of Patent Rights in Europe
  • The Hard Impact of Soft Skills

  • Oral Proceedings before the EPO and the UPC

7th Module

  • Introduction into legal working technique in civil proceedings governed by the principle of party representation
  • EU Antitrust Law and IP i.e. Patent Law
  • Deliberation of the case in the Court Group and preparation of the interim conference and the main hearing
  • Provisions of the Rules of Procedure relevant to Oral Hearings
  • Mock Trial Interim Conference

8th Module

  • Drawing of the examination paper topics
  • The Hard Impact of Soft Skills
  • Mediation/Arbitration alternatives to litigating patents in Europe and Mock Mediation
  • Preparation Mock Trial Main Hearing

The Course Fee for the 2019/20 Course is 2790 €.
